1. Parties
The platform: Oleg Tarassenko, trading as HotelsCasa, Tax ID X2630452B, Calle Senyera 20, 46190 Riba-roja de Túria (Valencia), Spain, email [email protected] (hereinafter, “HotelsCasa” or “the platform”).
The client: the natural or legal person who posts a transport job on the board, with the data declared in their account.
2. Purpose
HotelsCasa provides the client with an intermediation service (information society service, Law 34/2002): publishing their job, receiving offers from verified carriers, communicating with them via chat, hiring one, paying with the amount withheld until delivery, and receiving the transaction documents. The transport is carried out by the chosen carrier, with whom the client directly enters into the transport contract (Law 15/2009 on the contract for the overland carriage of goods; CMR Convention for international transport). HotelsCasa does not transport, does not hold the goods, and is not a party to that contract.
3. Account and jobs
- To post a job, make an offer, or write in the chat, an account with truthful data is required. Companies must also provide their corporate name, Tax ID, and address, which will appear on their invoices.
- The client describes the goods accurately (what they are, packages, size and weight), the pickup and delivery points, the dates, and the details of the recipient. An inaccurate description is the client’s responsibility and may justify the carrier refusing the pickup.
- Goods whose transport is prohibited or requires specific authorization that the client cannot prove (dangerous goods, live animals, cash, weapons, illegal substances) may not be ordered.
4. Offers, chat, and choice
Carriers send offers with a price. The client can consult via chat before choosing. When an offer is chosen, the carrier has five minutes to confirm; if they do not, the job returns to the board and the client chooses another. The details are in the board rules, which form part of this contract.
5. Price, commission, and payment
- The carriage price is that of the chosen offer and corresponds to the carrier.
- The HotelsCasa commission is calculated on the carriage price at the percentage shown when posting the job, VAT included, and is shown itemized before payment. It is the only amount HotelsCasa charges for itself.
- Payment is made by card through the platform. The total amount remains withheld on the card and is only charged when delivery is confirmed with the code or QR of the recipient. HotelsCasa charges the carriage fee on behalf of and for the account of the carrier and transfers it to them; it is not HotelsCasa income.
- The carrier’s contact details are opened to the client when the amount is withheld.
6. Pickup, delivery, and confirmation
The carrier notifies the pickup. Delivery is confirmed with the marks of both parties: the carrier in their dashboard and the client on their shipment page; with both, the withheld amount is charged. The client also receives a delivery code (SMS, email, and QR) that they can give to whoever opens the door if they will not be there: once that code is given to the carrier, it counts as both marks. HotelsCasa does not communicate with anyone other than the client and the carrier. If the carrier has marked delivery and the client does not confirm it or report an issue via chat within three days, delivery is deemed confirmed and payment is charged. The client must note any damage or shortage in the goods to the carrier at the time of delivery, or within the deadlines of Law 15/2009.
7. Cancellations and refunds
- With the amount withheld and before pickup, the client can cancel from their dashboard. Once the cancellation is confirmed by the carrier, the hold is fully released: the client pays neither the carriage fee nor the commission.
- After pickup, the job cannot be cancelled; issues are resolved between the client and the carrier.
- If the carrier does not confirm or does not show up, the client pays nothing and can choose another offer.
8. Invoices and receipts
- Business or professional client: upon delivery confirmation, they receive the carrier’s invoice (or receipt, if the carrier is an individual) for the carriage fee and the HotelsCasa invoice for the commission, both by email and in their dashboard, with joint download for their accountant.
- Private client: they receive the carrier’s receipt for the carriage fee and the HotelsCasa simplified invoice for the commission, without needing to provide tax data. If they need a full invoice, they can request it from the carrier and from HotelsCasa by providing their Tax ID and address.
- The carrier’s invoices are issued by HotelsCasa in their name and on their behalf, by mandate of the carrier, in accordance with the invoicing regulations.
9. HotelsCasa liability
HotelsCasa is liable for the provision of the intermediation service: posting the job, the offer and chat system, withholding and charging payment, notifications, and documents. It is not liable for the performance of the transport or the goods: the preservation of what is sent, damages, losses, delays, and undelivered shipments are the carrier’s responsibility to the client, in accordance with Law 15/2009, and must be claimed from them. HotelsCasa is also not liable for the truthfulness of the data declared by carriers beyond the identity verification it performs. HotelsCasa’s liability for the intermediation service is limited to the amount of the commission charged for the job in question, except in cases of intent or gross negligence.
10. Consumer rights
When the client is a consumer (Royal Legislative Decree 1/2007), they are entitled to the rights recognized by that regulation. The HotelsCasa intermediation service is fully performed once the carrier is confirmed and the payment is withheld; the client expressly accepts that the service begins at that moment and acknowledges that, once pickup has taken place, they lose the right of withdrawal regarding that job. Until pickup, they can cancel at no cost in accordance with section 7. 11. Personal data
HotelsCasa processes the client’s data in accordance with the privacy policy. The job data (addresses, recipient’s phone number) are shared with the chosen carrier solely to carry out the transport. The client guarantees that they can provide the recipient’s data.
12. Proper use
It is prohibited to post fake jobs, use the chat for purposes unrelated to the job, hire outside the platform a carrier met through it to avoid the commission, or any use contrary to the law. HotelsCasa may suspend the account in such cases.
13. Modifications
HotelsCasa may modify these conditions and the board rules; changes are published on the platform and apply to jobs posted afterwards. Each job is governed by the conditions in force when it is posted.
14. Applicable law and jurisdiction
This contract is governed by Spanish law. For disputes with HotelsCasa, the courts and tribunals of Valencia (Spain) shall have jurisdiction, except when the client is a consumer, in which case those of their domicile shall have jurisdiction.
