Terms of Use — HotelsCasa

The essentials: HotelsCasa connects those who offer accommodation, a car, a transfer or a transport service for people or goods with those who are looking for it. The contract is concluded between these two parties, not with us. This explains how the platform is used; the economic conditions are in the General Conditions. 
1. Purpose and acceptance
 These terms govern access to and use of hotelscasa.com. Using the platform — browsing, registering, publishing, or booking — implies acceptance of them in their current version at that time. 
2. Who can use it
Individuals over 18 years of age with the capacity to enter into obligations.
With truthful data: real and active name, phone, and email.
One person, one account. Duplicate accounts created to evade a suspension or to multiply commissions are all closed.
3. What we are and what we are not
 We are intermediaries. We facilitate contact, the calendar, communication, and, where applicable, payment. We do not own the accommodations or vehicles, we do not manage them, and we are not a party to the contract between host and guest. 
 We are not a transport or taxi company, nor an operator of vehicles with a driver. The drivers, fleets and carriers who publish on HotelsCasa provide the service in their own name and are solely responsible for having the licenses, authorizations (taxi, VTC or others), insurance and permits required by the regulations of their country. 
 The accuracy of each listing — description, photographs, price, availability, licenses, and permits — is the responsibility of the person who publishes it. We verify what we can reasonably verify, and that does not make us guarantors of what a third party declares. 
4. Your account
 Access is personal. You are responsible for what happens from your account and for keeping the means by which you log in — phone and email — secure. If you suspect unauthorized access, notify us immediately at [email protected]. 
5. Prohibited conduct
The following is expressly prohibited:
Bypassing the platform. Using contact obtained here to close the booking externally and evade the commission. If detected, it leads to account closure and a claim for amounts not received. 
Publishing contact details — phone, email, social media — within listings or messages for that same purpose.
Publishing false, duplicate, or third-party property listings, or with photographs that do not correspond to the actual item.
Manipulating reviews: writing them yourself, commissioning them, or conditioning the guest in exchange for something.
Extracting site content in an automated or systematic manner, or interfering with its operation.
Impersonating HotelsCasa or promising on our behalf what we do not promise.
Any use contrary to the law, and in particular offering accommodation or transport services without the licenses required by local regulations.
6. Content you publish
 It remains yours. By publishing it, you authorize us to display it on the platform and to promote your own listing, also on our social networks. The rights, warranties, and the removal procedure are detailed in the Intellectual Property Notice. 
7. Prices, bookings, and commission
 Prices are set by each host or owner. The intermediation commission, invoicing, cancellations, and refunds are governed by the General Conditions, which prevail over this document in all economic matters. 
8. Service availability
 We work to keep the platform continuously available, but we do not guarantee that it will operate without interruptions. We may temporarily suspend it for maintenance, security, or external causes, endeavoring to notify when foreseeable. 
9. Liability
 We are liable for damages arising directly from our own breach. We are not liable for the conduct of hosts, owners, drivers, carriers, guests or passengers, the actual state of the accommodation or the vehicle, nor for the provision of the transport service, nor for indirect damages or loss of profit. 
 Nothing above limits liability that the law does not permit excluding, nor the rights corresponding to those who contract as consumers. 
10. Suspension and closure
 We may suspend or close an account that breaches these terms, stating the reason. Obligations already incurred — confirmed bookings, pending payments, accrued commissions — are settled normally: closure does not serve to stop paying or receiving. 
 You can cancel your account whenever you wish. How to do it and what happens to your data is in the Privacy Policy. 
11. Changes to these terms
 We may modify them. Changes are published on this page with their date, and substantial ones are notified by email. Continuing to use the platform afterward implies acceptance; if you do not agree, you can cancel without cost. 
12. Applicable law
 Spanish legislation applies. For any dispute, the courts and tribunals that correspond according to the law shall have jurisdiction, without prejudice to the consumer's right to their own jurisdiction.
