Content Use Licence — HotelsCasa

1. What it protects

The photographs, images and illustrations of hotelscasa.com (including the vehicle drawings signed hotelscasa.com), its texts, the listings of accommodation, vehicles, excursions, transfers and companies, the rates and the database as a whole (sui generis right, arts. 133–137 of the Spanish Intellectual Property Act).

2. What you may do without permission

Browse the website, share the link to a page, the previews generated by social networks and messaging apps, and indexing by search engines that link to the original.

3. What requires a written licence

Copying, downloading or publishing any item on another website, app, portal, catalogue or social network; using it for commercial purposes; extracting it automatically (bots, scraping), including to train artificial intelligence models; and reusing the database, even in parts.

4. Licence fee

The commercial use licence costs €1,000 per item (VAT excluded). An item is each photograph or image, each listing (the page of an accommodation, vehicle, excursion, transfer or company) and each text. Anyone using an item without a written licence owes that amount: HotelsCasa will claim it as the remuneration it would have received for the licence (art. 140.2.b of the Spanish Intellectual Property Act), plus any greater damage it proves.

5. Marks and author signature

Our images carry visible and invisible marks and the author’s signature inside the file. The marks identify the origin, the date and to whom each copy was delivered. Removing, covering or altering a mark or the author’s signature is a separate infringement (art. 162 of the Spanish Intellectual Property Act) and adds €1,000 for each altered item.

6. Evidence

The marks in the image, the delivery log of our servers, the fingerprint of each photograph and dated captures of the copy serve as evidence.

7. What we do about unlicensed use

We demand payment of the licence and removal. If this is not done within 10 days, we request removal from the infringer’s hosting provider and search engines and take the civil and criminal action that applies; we may entrust the search and collection to specialised companies.

8. Content of our partners

The photos and texts published by hosts, companies and organisers remain theirs. This licence protects their presentation on HotelsCasa and our database; with partners, their contract also applies.

9. Applicable law

This licence is governed by Spanish law. Any dispute falls under the courts and tribunals competent by law, without prejudice to the consumer’s own forum.
