General Terms and Conditions of Use and Booking
HotelsCasa · European vacation rental platform Last updated: July 16, 2026
HotelsCasa is a platform that connects travelers (hereinafter,
1 1. Introduction and acceptance
HotelsCasa is an online service that facilitates the meeting between Guests and Hosts for booking tourist accommodations. These Terms, together with the Privacy Policy and the specific conditions of each accommodation, form the agreement between you and HotelsCasa.
If you do not agree with these Terms, you must not use the platform or make bookings through it. We may update these Terms when necessary; the current version will always be the one published on this page, with its update date.
2 2. Definitions
For the purposes of these Terms, the following definitions apply:
- Platform: the website and services of HotelsCasa.
- Host: the natural or legal person who publishes and offers an accommodation (may be an individual or a professional).
- Guest: the person who books or uses an accommodation through the Platform.
- Accommodation: the property, room, hotel, or bookable unit published by a Host.
- Booking: the stay agreement between the Guest and the Host, managed through the Platform.
3 3. Role of HotelsCasa (intermediary)
HotelsCasa acts exclusively as an INTERMEDIARY: we provide the Host with the tools to publish their accommodation and the Guest with the tools to find and book it. HotelsCasa is not the owner, lessor, or manager of the accommodation, and does not provide the lodging service.
The stay contract is entered into directly between the Guest and the Host. The information for each accommodation (description, photographs, services, price, availability, rules, and licenses) is provided by the Host, who is solely responsible for its accuracy and updating.
HotelsCasa is not a party to said contract and does not assume the Host's obligations towards the Guest, without prejudice to the assistance the Platform may offer to facilitate communication and booking.
4 4. User account
To book or publish accommodations, you may need to create an account. You must provide truthful information and keep it updated, and you are responsible for the confidentiality of your credentials and for the activity carried out from your account.
You can register as a Traveler or as a Host. HotelsCasa may suspend or cancel accounts that breach these Terms, provide false data, impersonate third parties, or engage in fraudulent or abusive use of the Platform.
5 5. Booking process
By submitting a booking request, the Guest accepts the price, dates, number of people, accommodation rules, and applicable cancellation policy, shown before confirming.
Some accommodations are confirmed immediately; others require prior acceptance by the Host. When an accommodation does not show a price or calendar, the booking is processed as a request: the Host responds to each inquiry with their availability and conditions.
Confirmation of the booking creates a stay contract between the Guest and the Host in accordance with the conditions shown at the time of booking.
6 6. Prices, payments, and taxes
Prices are shown in euros and include the items indicated in the breakdown of each booking (for example, accommodation, cleaning fees, and tourist tax when applicable). Before confirming, you will always see the total amount to be paid.
Payments are processed through secure payment providers (Stripe). HotelsCasa does not store your full card details.
The tourist tax and any applicable taxes are governed by the regulations in force at the accommodation's location. The Host is responsible for complying with their tax obligations arising from the lodging activity.
7 7. Paid digital services
Some Platform services are provided through one-time payments, such as access to additional contact details of listings (the first three per day are free; from the fourth onward, €1 per number).
These services are digital content with immediate delivery: the data is sent to the email or phone declared on the account at the time of payment. By contracting them, the user expressly accepts this immediate delivery and acknowledges that, consequently, they lose the right of withdrawal provided for distance contracting. Therefore, these purchases are NOT refundable.
Purchased balances do not expire and are personal and non-transferable. The Platform may cancel balances obtained fraudulently or through subsequent non-payment.
8 8. Invoices
Many accommodations are managed by private Hosts, not companies. As they are not a company, the Host may NOT be able to issue an invoice for the expenses of your stay.
If you need an invoice for professional reasons, we recommend checking with the Host before booking. HotelsCasa, as an intermediary, is not the provider of the accommodation service and, therefore, does not issue the invoice for the stay on behalf of the Host.
When the Host is a professional or company, invoice issuance will be governed by the tax regulations applicable to them.
9 9. Modifications and cancellations
Each accommodation has a cancellation policy defined by the Host (for example: flexible, moderate, strict, or non-refundable), which is shown before booking and forms part of the stay contract.
Modification or cancellation requests are processed through the Platform and are governed by the policy applicable to the booking. Refunds, when applicable, are made through the same payment method used.
In the event that the Host cancels a confirmed booking, HotelsCasa will facilitate the Guest's management of the refund of the amount paid through the Platform in accordance with the booking conditions.
10 10. Arrival, stay, and departure
The Guest must respect check-in and check-out times, the maximum number of people, and the rules of coexistence and use of the accommodation indicated by the Host.
The Host may request a security deposit or guarantee to cover potential damages; its conditions are indicated in the accommodation listing or at the time of booking.
The Guest is responsible for damages caused to the accommodation during their stay, beyond normal wear and tear from use.
11 11. Guest obligations
The Guest agrees to:
- Provide truthful data and use the accommodation in accordance with its purpose and the Host's rules.
- Respect the accommodation, neighbors, and local regulations (noise, number of occupants, pets, etc.).
- Not use the accommodation for unlawful purposes or for unauthorized parties or events.
- Report any incident to the Host and, if necessary, to the Platform, as soon as possible.
12 12. Host obligations and liability
The Host is solely responsible for ensuring their accommodation complies with applicable legislation, including, when applicable, the tourist license or registration number, habitability and safety standards, and their tax obligations.
The Host guarantees that the published information is truthful and updated, and that they have the necessary authorizations to offer the accommodation as a vacation rental.
The lodging relationship and liability towards the Guest for the provision of the accommodation correspond to the Host, not to HotelsCasa.
13 13. Reviews and user content
After the stay, the Guest may publish a review. Reviews must be genuine, respectful, and based on personal experience. HotelsCasa may moderate, refuse to publish, or remove content that is offensive, false, unlawful, or includes personal or contact data.
By publishing content (texts, photographs, reviews), you grant HotelsCasa a non-exclusive license to display it on the Platform for the purpose of providing the service.
14 14. Communication between the parties
Communication between Guest and Host is carried out through the Platform. For security and to protect both parties, direct contact details may be hidden, and messaging may filter contact information.
The identity and contact details of the Host are managed by the Platform and may not be publicly displayed.
15 15. Limitation of liability of the Platform
Since HotelsCasa acts as an intermediary, it is not responsible for the quality, safety, legality, or accuracy of the accommodations, which are the Host's responsibility. It is also not responsible for the conduct of Guests or Hosts.
HotelsCasa takes reasonable measures to ensure the Platform functions correctly, but does not guarantee uninterrupted availability or the absence of errors. To the extent permitted by law, HotelsCasa's liability is limited to the intermediation services actually provided.
No clause in these Terms excludes or limits liability that cannot be legally excluded, nor the rights that consumer regulations grant to the Guest when applicable.
16 16. Loyalty program
HotelsCasa may offer a loyalty program whereby nights actually paid generate a bonus in euros, redeemable according to its specific conditions and with a determined validity period.
The bonus is a Platform incentive; its rules, amounts, and validity may be updated and are detailed in the corresponding section of the program.
17 17. Data protection (GDPR)
The processing of your personal data is governed by Regulation (EU) 2016/679 (GDPR) and applicable Spanish regulations, as detailed in the Privacy Policy.
We process your data to manage registration, bookings, payments, communication between the parties, and compliance with our legal obligations. You can exercise your rights of access, rectification, deletion, opposition, restriction, and portability as indicated in said Policy.
18 18. Intellectual property
The brand, design, software, and proprietary content of the Platform are protected by intellectual and industrial property rights and may not be reproduced or used without authorization, except for normal use to browse and book.
19 19. Claims and dispute resolution
For any claim, you can contact us through the Contact page. We will try to help you resolve issues related to the booking within the framework of our role as intermediary.
If you are a consumer residing in the EU, you can use the European online dispute resolution platform (ODR) available on the European Commission's website. This does not prevent you from pursuing the administrative or judicial channels that correspond to you.
20 20. Applicable law and jurisdiction
These Terms are governed by Spanish legislation and, where applicable, by European Union law. For the resolution of disputes, the courts and tribunals determined by applicable regulations shall be competent, respecting, when the Guest is a consumer, the jurisdiction legally corresponding to them.
21 21. Modifications and contact
HotelsCasa may modify these Terms to adapt them to legal, technical, or service changes. Changes will be published on this page with their update date and will be applicable to bookings made from their entry into force.
For any questions about these Terms, write to us through the Platform's Contact page.
